Please read these Terms of Service carefully before using the RowX application operated by RowX LLC ("RowX," "we," "us," or "our"). By creating an account, you agree to be bound by these Terms.
1. Description of Service
RowX provides an adaptive athletic training application for masters scullers and rowing athletes, including personalized training plan generation, session logging, performance tracking, adaptive recalibration, an AI-powered coaching agent, crew boat session tools, and related features.
2. Eligibility
You must be at least 18 years of age to use the Service.
3. Account Registration
You agree to provide accurate information, keep your password confidential, notify us of unauthorized use, and be responsible for all activity under your account.
4. Health and Fitness Disclaimer
IMPORTANT: The Service is NOT a substitute for professional medical advice, diagnosis, or treatment.
- Consult your physician before beginning any new training program
- The AI coaching agent is not a licensed coach, physician, or dietitian
- Nutritional information is general guidance only, not individualized dietary advice
- Training targets and heart rate zones are estimates, not medical prescriptions
- You assume all risk associated with your athletic training and rowing
- RowX is not responsible for injury, illness, or adverse outcomes from following Service recommendations
- If you experience chest pain, severe shortness of breath, dizziness, or fainting during exercise, stop immediately and seek emergency medical care
5. Subscription and Payment
5.1 Subscriptions
Subscriptions are billed monthly or annually in advance. Pricing is displayed in the app.
5.2 Payment authorization
Payment is processed by Stripe. You authorize RowX to charge your payment method for subscription fees.
5.3 Cancellation
Cancel anytime through Account settings. Cancellation takes effect at end of current billing period. No refunds for partial periods except where required by law.
5.4 Free trials
Free trials convert to paid subscriptions at trial end unless cancelled.
6. Acceptable Use
You agree not to: use the Service unlawfully, share account credentials, attempt unauthorized access, reverse engineer the Service, use automated scraping tools, upload malicious code, harass other users, or misrepresent your identity.
7. Intellectual Property
7.1 Ownership of the Service
The Service, including its algorithms and training methodologies, is owned by RowX LLC and protected by intellectual property laws.
7.2 Your data
You retain ownership of your personal data. You grant RowX a limited license to use your data to provide and improve the Service.
7.3 Feedback
Feedback you provide may be used by RowX without compensation.
8. Connections and Social Features
By using social features: your username is searchable by other users, connected athletes may see your visible activity, your performance pace reference is used in crew session calculations, and you are responsible for managing your privacy settings.
9. AI Coaching Agent
Agent responses are generated by AI, may contain errors, are not licensed professional advice, and your conversation content is processed by Anthropic's API. Do not rely on agent responses as a substitute for professional medical or coaching advice.
10. Disclaimers and Limitation of Liability
10.1 Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
10.2 Limitation of liability
ROWX SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED AMOUNTS PAID BY YOU IN THE PRECEDING TWELVE MONTHS.
10.3 Assumption of risk
You expressly assume all risks associated with athletic training and rowing.
11. Indemnification
You agree to indemnify RowX from claims arising from your use of the Service or violation of these Terms.
12. Termination
We may suspend or terminate your account for violations of these Terms. You may terminate your account by contacting mckinley@row-x.com.
13. Governing Law and Dispute Resolution
These Terms are governed by Tennessee law. Disputes shall be resolved by binding arbitration in Hamilton County, Tennessee under AAA rules, except either party may seek injunctive relief for IP violations.
14. Changes to Terms
We will notify you of material changes at least 14 days before they take effect.
15. Miscellaneous
These Terms constitute the entire agreement between you and RowX. If any provision is unenforceable, remaining provisions continue in effect.
